Sleep Support Package Terms and Conditions

1. The purchase of a Sleep Support or Guidance Package (the “Package”) will be deemed as acceptance of the following terms and conditions.

2. The full fee for Little Bunnies Sleep Consultant services is due on booking your Package with Little Bunnies Sleep Consultant.

​

3. If the package is cancelled by the Client (the payer and receiver of the Package) the following terms and conditions apply:

• Less than 48 hours before booked consultation call – no amount will be refunded

• Cancellation after consultation call has been booked, but more than 48 hours before the call is due to start – 50% of full amount will be refunded

• Cancellation before sleep logs have been returned AND before consultation call is booked – 100% will be refunded to the client

4. If a Client demonstrates exceptional circumstances as the reason for a cancellation within 48 hours of the booked consultation time, Little Bunnies Sleep Consultant may, on a case by case basis, offer an alternative consultation time without financial penalty.

 

5. Little Bunnies Sleep Consultant reserves the right to cancel consultations or Packages at short notice due to personal circumstances, thought will always endeavour not to do so. In the event of Little Bunnies Sleep Consultant cancelling, the Client will be offered a full refund or alternative dates if preferred.

 

6. It is expected that any Package of coaching or support will commence within two weeks of the sleep plan being sent by Little Bunnies Sleep Consultant to the Client.  If a Client delays starting the support for more than two weeks, Little Bunnies Sleep Consultant reserves the right to levy additional charges in order to make ammendments to the sleep plan based on the child's changing age, development and sleep needs.  Additionally, Little Bunnies Sleep Consultant may require additional logs to be completed.  Any additional charges will be no more than 50% of the original package cost. 

 

7. If a Client purchases a Package with ongoing support but delays starting that support for over two months, the contract between the Client and Little Bunnies Sleep Consultant will be considered to be complete.  The Client will have continued possession of their personalised sleep plan should they choose to implement it themselves in future.  The Client will continue to be subject to any relevant Terms and Conditions below.  In exceptional circumstances, Little Bunnies Sleep Consultant may, on a case by case basis, agree to commence a Package of support more than two months after the original sleep plan was provided to the Client, subject to any relevant fees for ammending the sleep plan to meet the child's current age-related and development needs. 

 

8. In respect of each Package sold by Little Bunnies Sleep Consultant to the Client, the Client agrees that it shall not provide the Package or any of its products to any third party who is not a Client.

 

9. Advice given by Little Bunnies Sleep Consultant is intended as advice related to supporting infant sleep only and is not intended as a substitute for medical advice from a GP or other medical expert.

 

10. Little Bunnies Sleep Consultant advises to the best of their ability, experience and training but does not accept responsibility or liability for sleep and behavioural work that does not achieve the desired result following the purchase of a sleep Package.

 

11. If the Client’s child has an underlying health condition which was either not made clear during the Introductory call, or emerges to be more significant that initially described, Little Bunnies Sleep Consultant reserves the right to not proceed with the Package. If this is the case, the Client will receive a full refund.

 

12. Little Bunnies Sleep Consultant is contactable at any time during the day or night during the support period (subject to the Package purchased) but will only be expected to respond to the Client during the hours of 8am-8pm. Little Bunnies will endeavour to return messages during this time without undue delay, but provides no guarantee that responses will be instantaneous as other consultations and activities may be taking place. 

 

13. Little Bunnies Sleep Consultant is entitled to request reviews from purchasers of all Packages and may be in touch following the end of the package in order to make such a request.

 

14. Little Bunnies Sleep Consultant reserves the right to cease the provision of support in exceptional circumstances, including but not limited to: abuse or harassment from a Client to one of the Little Bunnies Sleep Consultant team; evidence that a Client is in direct contravention of Item 6. In such cases, no refund will be offered.

 

15. Little Bunnies Sleep Consultant reserves the right to change the Terms & Conditions at any time.

 

Website Terms of Use

These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and Little Bunnies Sleep Consultant Ltd, the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by Little Bunnies Sleep Consultant Ltd and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Little Bunnies Sleep Consultant Ltd and accessing the Website in connection with the provision of such services.

You must be at least 18 years of age to use this Website. By using the Website and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age.

Intellectual property and acceptable use

1. All Content included on the Website, unless uploaded by Users, is the property of Little Bunnies Sleep Consultant Ltd, our affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission

 

2. You may, for your own personal, non-commercial use only, retrieve, display and view the Content on a computer screen

 

3. You must not otherwise reproduce, modify, copy, distribute or use for commercial purposes any Content without the written permission of Little Bunnies Sleep Consultant Ltd.

4. You may not use the Website for any of the following purposes:

a. in any way which causes, or may cause, damage to the Website or interferes with any other person’s use or enjoyment of the Website;

Whilst Little Bunnies Sleep Consultant Ltd uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware.  We give no warranty or guaranty in that regard and all Users take responsibility for their own security, that of their personal details and their computers.

 

10. Little Bunnies Sleep Consultant Ltd accepts no liability for any disruption or non-availability of the Website.

Little Bunnies Sleep Consultant Ltd reserves the right to alter, suspend or discontinue any part (or the whole of) the Website including, but not limited to, any products and/or services available. These terms and conditions shall continue to apply to any modified version of the Website unless it is expressly stated otherwise.

 

Limitation of Liability

1. Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or (c) limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.

 

2. We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.

 

3. To the maximum extent permitted by law, Little Bunnies Sleep Consultant Ltd accepts no liability for any of the following:

a. any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;
b. loss or corruption of any data, database or software;
c. any special, indirect or consequential loss or damage.

 

General Terms

1. You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

 

2. These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.

 

3. These terms and conditions contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.

 

4. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions and no third party will have any right to enforce or rely on any provision of these terms and conditions.

 

5. If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected.

 

6. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.

 

7. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.
